By accessing or using Fablery ("the Service"), operated by Lumenry Group ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Fablery is a web-based creative writing companion application that provides writers with tools to plan, write, and manage their fiction projects. The Service includes a writing room, scene planning tools, character studio, world builder, beat planner, craft vault, achievement system, and related features.
Fablery does not generate, suggest, or write any story content on behalf of users. All creative content produced using the Service is created entirely by the user.
You must be at least 13 years of age to use the Service. By using Fablery you represent and warrant that you meet this requirement. If you are under 18 years of age you must have permission from a parent or legal guardian.
To access most features of the Service you must create an account by providing a valid email address and creating a password, or by authenticating via a supported third-party provider such as Google.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@fablery.app if you become aware of any unauthorised use of your account.
You agree to provide accurate and current information when creating your account and to keep your information updated.
Fablery offers a free plan with limited features. No payment is required for the free plan.
Fablery Forever is a lifetime software licence available for a one-time payment of USD $39. This licence grants permanent access to the complete Fablery creative toolkit as described on our pricing page. The licence is for personal, non-commercial use by a single individual.
Fablery Pro is available as a monthly subscription at USD $9.90 per month or an annual subscription at USD $69 per year. The subscription grants access to advanced features in addition to all Fablery Forever features. Subscriptions automatically renew at the end of each billing period unless cancelled.
All payments are processed by Lemon Squeezy, our Merchant of Record. Lemon Squeezy handles all payment processing, tax collection, and compliance on our behalf. By making a purchase you also agree to Lemon Squeezy's terms of service available at lemonsqueezy.com.
Fablery Forever purchases are eligible for a full refund within 14 days of purchase if you are not satisfied, provided you have not extensively used the Service. Subscription payments are non-refundable except where required by applicable law. To request a refund contact hello@fablery.app.
We reserve the right to change our pricing at any time. Existing Fablery Forever licence holders will not be affected by price increases. Existing Pro subscribers will be given 30 days notice before any price increase takes effect.
You retain full ownership of all content you create using Fablery, including but not limited to stories, characters, world building notes, scene planning, research, and all other written content ("User Content"). Lumenry Group claims no ownership rights over your User Content.
By using the Service you grant Lumenry Group a limited, non-exclusive, non-transferable licence to store, process, and display your User Content solely for the purpose of operating and providing the Service to you. This licence does not permit us to use your content for any other purpose including training AI models, marketing, or sharing with third parties.
We will never use your User Content to train artificial intelligence models. Your writing belongs to you entirely.
You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to all content you create or upload to the Service, and that your content does not violate any third-party rights or applicable laws.
You agree not to use the Service to:
Fablery does not use artificial intelligence to generate, suggest, complete, or rewrite any story content on behalf of users. All writing tools in Fablery — including expression generators, writing prompts, and craft tips — are reference and inspiration tools only. They do not write content for users. Every word in your story is written by you.
The Service, including its design, code, features, branding, illustrations, and all content created by Lumenry Group, is owned by Lumenry Group and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.
The Fablery name, logo, and brand assets are trademarks of Lumenry Group.
Your use of the Service is also governed by our Privacy Policy, available at fablery.app/privacy. By using the Service you consent to the collection and use of your information as described in the Privacy Policy.
The Service integrates with third-party services including Supabase (database and authentication), Lemon Squeezy (payment processing), and GoHighLevel (email communications). Your use of these integrated services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.
We strive to maintain the Service but do not guarantee uninterrupted or error-free access. The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by applicable law, Lumenry Group makes no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
While we implement multiple layers of auto-save functionality, we recommend that you maintain your own backups of important writing. Lumenry Group is not liable for any loss of User Content.
To the maximum extent permitted by applicable law, Lumenry Group and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of profits, arising from your use of or inability to use the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or USD $100, whichever is greater.
You may cancel your Pro subscription at any time through your account Settings page or by contacting hello@fablery.app. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until the end of the paid period, after which your account returns to the Fablery Forever tier if you hold a lifetime licence, or the Free tier if you do not.
We reserve the right to suspend or terminate your account if you violate these Terms. We will provide reasonable notice where possible.
Upon termination you may export your User Content before your account is closed. We will retain your data for 30 days after termination to allow for this export, after which it will be permanently deleted upon request.
We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice in the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
If you are located in the European Union, you may also have the right to submit a complaint to your local data protection authority.
